ASINScope Terms of Service

Thanks for using ASINScope! We aim to simplify product data research on e-commerce platforms like Amazon. This document (“Terms”) describes the rules and conditions under which you can use our services, software, APIs, and websites ("Services"). ASINScope is operated by PE Andrii Zborovskyi (a private entrepreneur registered in Ukraine) ("ASINScope", "we", "us").

1. Your Data and Amazon Information

Your Data: When you use our Services, you provide us with data like product ASINs, UPCs, EANs, and optionally other product information like titles, prices, etc. ("Your Data"). You own Your Data. These Terms don't grant us any rights over Your Data, except as needed to provide our Services. We need your permission for tasks like product lookup, product data storage, and accessing Amazon's API on your behalf. You grant us this permission, which also extends to our affiliates and trusted third parties we collaborate with.
Amazon Information: In line with Amazon's policies, any information retrieved from Amazon will be shared only with users of our service who have proper authorization. Users will only access information related to their Amazon accounts.

2. Licenses

Subject to your full and ongoing adherence to these Terms, ASINScope grants you a license to access and use the Services, whether for personal or commercial purposes, based on the service level for which you've paid any necessary fees.

3. Payments, Subscriptions and Billing

Some Services are offered on a paid basis, either as one-time purchases of points packages or as recurring subscriptions. By purchasing a paid plan you authorize us and our payment provider to charge the applicable fees.

Merchant of Record: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments are processed by Paddle.com Market Ltd (paddle.com), which acts as the reseller of our Services; Paddle appears as the seller on your receipt and card statement and handles billing, taxes, and refunds on our behalf.
Recurring billing: Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time, and your subscription remains active until the end of the current paid period.
Taxes: Unless stated otherwise, prices are exclusive of applicable taxes; any VAT or sales tax is calculated and collected by Paddle at checkout.
Price changes: We may change our prices from time to time; changes to recurring fees apply to billing periods after we notify you.
Refunds: Refunds are governed by our Refund Policy and by Paddle's Buyer Terms.

4. Disclaimer of Warranties

The Services are offered "as is" and "as available." We disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The accuracy, completeness, or utility of our website content is not guaranteed, and any reliance on it is at your own risk. Material obtained via our website is accessed at your discretion; we aren't responsible for any resulting damage or data loss. No advice or information, whether verbal or written, received from ASINScope will constitute any warranty not clearly stated in this agreement. Certain jurisdictions might prohibit warranty disclaimers; you might have additional rights in those places.

5. Limitation of Liability

To the maximum extent permitted by applicable law, ASINScope and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claim relating to the Services shall not exceed the amount you paid us for the Services during the three (3) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

6. Compliance with Amazon's Policies

If you use features associated with the Amazon API, you must adhere to Amazon's AUP and any other pertinent agreements. Failure to comply may result in penalties or the termination of your access to ASINScope's Services.

7. Governing Law

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-law principles. This does not deprive you of the protection afforded by mandatory consumer-protection provisions of the country in which you reside.

8. Modifications

We may revise these Terms at any time to better reflect:

Changes to the law,
New regulatory requirements, or
Improvements or enhancements made to our Services.

If an update affects your use of the Services or your legal rights as a user of our Services, we’ll notify you prior to the update's effective date by sending an email to the email address associated with your account or via an in-product notification. These updated terms will be effective no less than 30 days from when we notify you.

By continuing to use or access the Services after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Services.
